Terms of Service

1. Agreement to these terms

These Terms of Service ("Terms") are a legal agreement between you and Virality Now LLC ("Virality Now," "we," "us," or "our"), the company that operates Trend Alert Daily (the "Service"), including the website at trendalertdaily.com, the daily email or app editions, and any related content.

By creating an account, starting a free trial, purchasing a subscription, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

2. Who can use the Service

You must be at least 18 years old and able to enter into a binding contract to create an account or subscribe. By using the Service you confirm that you meet this requirement. We do not knowingly allow anyone under 18 to subscribe.

3. What the Service is

Trend Alert Daily is a subscription briefing. Each edition includes a selection of social media trends, suggested hooks, explanations of how each trend works, and examples. The content is general in nature and is the same for all subscribers. It is not tailored to your account, niche, or audience.

The Service is an independent product. It is not affiliated with, endorsed by, or sponsored by TikTok, Instagram, Facebook, YouTube, or any other platform. All platform names are used for identification only and belong to their respective owners.

4. Accounts

You are responsible for keeping your login details private and for all activity under your account. Tell us at hello@trendalertdaily.com right away if you think your account has been accessed without permission. You must give us accurate information when you sign up and keep it current.

5. Free trial

New subscribers may receive a free trial of 7 days. You will be asked for a payment method when you start the trial.

When the trial ends, your selected subscription begins and your payment method is charged automatically at the then current price: currently $17 USD per month or $150 USD per year, unless you cancel before the trial ends.

You can cancel at any time during the trial and you will not be charged. One free trial per person. We may change or end the trial offer at any time for new subscribers.

6. Subscription and automatic renewal

The Service is sold as a monthly or annual subscription.

Your subscription renews automatically at the end of each monthly or annual billing period, and your payment method on file is charged the applicable price at the start of each new billing period, until you cancel.

By subscribing, you authorize us and our payment processor to charge your payment method on a recurring basis. If a payment fails, we may retry it and may suspend or end your access until payment is made.

We may change the price of the Service. If we do, we will notify you by email at least 30 days before the new price takes effect. If you do not cancel before the new price applies, you agree to pay the new price.

7. How to cancel

You can cancel your subscription at any time from your account page at trendalertdaily.com/account or by emailing hello@trendalertdaily.com. Cancelling is as simple as signing up and takes effect at the end of your current billing period. You keep access until then. We do not charge cancellation fees.

8. Refunds

We offer a 14-day satisfaction guarantee on the most recent monthly or annual subscription payment. To qualify, you must have tried at least five trends from the Service and contact us through trendalertdaily.com/contact within 14 days after that payment. You may tell us that you completed the five attempts; we may review account activity only to identify clear inconsistencies or abuse.

The guarantee is limited to one refund per customer. If we approve a refund, we will refund your most recent subscription payment in full, cancel your subscription, stop future renewals, and end your paid access. The guarantee does not promise views, followers, sales, or any other result.

Except for this guarantee, charges made in error, refunds required by law, or prepaid amounts owed if we discontinue the Service, payments are non-refundable. We do not provide partial refunds or credits for unused time.

9. Payment processing

Payments are handled by a third party processor, currently Stripe. We do not store your full card number. Your use of the processor is subject to that processor's own terms and privacy policy.

10. Your license to use the content

When you subscribe, we give you a limited, personal, non exclusive, non transferable license to read and use the content of the Service for your own social media posting.

You may use the trends, hooks, and ideas we provide to create your own posts, including on any platform.

You may not:

• Share, forward, resell, or republish editions or any substantial part of them.
• Post our content, in whole or in part, as a product, newsletter, course, or service of your own.
• Share your login with others or let others use your account.
• Copy, scrape, or store our content in bulk, or use it to train any software or model.
• Remove any notices about ownership from our content.

All content in the Service, including the selection and arrangement of trends and hooks and the explanations we write, belongs to Virality Now LLC or its licensors and is protected by copyright and other laws. The trends themselves describe activity on public platforms and we do not claim to own any third party video, sound, or format referenced.

11. Your content

Anything you post on TikTok or another platform using our ideas is yours. You are responsible for it and for following that platform's rules, including rules on music, sounds, and other people's material.

If you send us feedback, screenshots, or testimonials, you give us permission to use them to improve and promote the Service, without payment, unless you tell us in writing that you do not want them used.

12. No guarantee of results

The Service gives information and ideas. It does not guarantee views, followers, sales, or any other outcome. Trends change quickly and a trend that is rising when we send it may fall soon after. Results depend on your content, your account, platform algorithms, and factors we do not control.

Nothing in the Service is legal, financial, or professional advice.

13. Acceptable use

You agree not to use the Service to break any law, to infringe anyone's rights, to harass or harm others, or to interfere with the Service or its security. We may suspend or end your account if you violate these Terms, without refund.

14. Changes to the Service

We may add, change, or remove features, or change the number or format of items in an edition, at any time. We will try to give notice of major changes by email. We may stop offering the Service entirely, in which case we will refund any prepaid amount for the period after the Service ends.

15. Disclaimers

The Service is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non infringement. We do not promise that the Service will be uninterrupted, error free, or delivered at a particular time each day.

16. Limitation of liability

To the fullest extent permitted by law, Virality Now LLC and its owners, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising from your use of the Service.

Our total liability to you for any claim related to the Service will not exceed the amount you paid us in the 12 months before the claim arose, or $50 USD, whichever is greater.

Some jurisdictions do not allow these limits. In that case they apply to the extent permitted.

17. Indemnity

You agree to defend and hold harmless Virality Now LLC from any claim, loss, or expense, including reasonable attorney fees, arising from your content, your use of the Service, or your violation of these Terms or of any third party's rights.

18. Governing law and disputes

These Terms are governed by the laws of the State of Illinois, without regard to its conflict of law rules. Any dispute will be brought in the state or federal courts located in McHenry County, Illinois, and you consent to their jurisdiction.

Before filing any claim, you agree to contact us at hello@trendalertdaily.com and try in good faith to resolve it informally for at least 30 days.

19. Changes to these terms

We may update these Terms. If the change is material, we will email you or post a notice on the Service at least 14 days before it takes effect. Continued use after that date means you accept the new Terms. The effective date at the top shows when these Terms were last changed.

20. General

If any part of these Terms is found unenforceable, the rest stays in effect. Our failure to enforce a term is not a waiver of it. You may not transfer your account or these Terms to anyone else. We may transfer our rights under these Terms to a successor. These Terms and the Privacy Policy are the entire agreement between you and us about the Service.
